According to the judgment of the Federal Constitutional Court of 15 April 2019, Section 6a (1) numbers 2 and 3 and Section 6a (2) number 1 in conjunction with subsection (1) numbers 2 and 3 of the European Elections Act (EuWG) must not be applied to applications for registration in the voters' register nor to objections and complaints against the correctness or completeness of the voters’ registers in the European Election in Germany on 26 May 2019.
Therefore, only people who are not entitled to vote owing to a judicial decision are disqualified from voting in the 2019 European Election.
In addition Union citizens are disqualified from voting in European elections if they are not entitled to vote in elections to the European Parliament in the EU member state of which they are a citizen (home member state) due to an individual civil or criminal law decision.
